Hello All,
I e-filed my AP on August 5th 2010 and sent all my papers to NSC. I received a notice they they received my application with the same date. My last AP expired on 30 July 2010.
I have a wedding coming up in family that I want/need to attend. Is it possible for me to use this reason to expedite my AP? Also has anyone been in similar situations? Any feedback is greatly appreciated.
Thanks

Yes, my EAD was approved and stay with same employer. What happen if I don't go out of country after I get a fresh H1B approval notice?
Yes, you can renew if your 140 is approved, i have done mine, my H1B was expired and used EAD for 2 months, and again file fresh H1B and got approved and went out of country to get stamp done,
Thanks,

I think that it was a trial balloon. I have seen this pattern for most of the major issues this administration is planning to tackle. Take TARP for example...for a month one would just hear leaks about proposed solutions. Media would pick it up and give a reaction, the next leak would be an updated version based on the feedback. Such articles help keep the issue in the forefront, help gauge the reaction (both positive and negative) and provide a simple exit to backtrack incase of major opposition.

Hi Friends,
I just want to say, I just contributed $100 (Confirmation Number: 2XJ23352J19006734) and this is my first contribution ever and have done it just for IV. And am very proud about this.
I came to know about IV, 2 weeks ago when I heard of the flower campaign from my friend . We are very fortunate to have IV with us and thousands of users in IV helping each other.
I am sure with out IV initiative , it would have been very hard to achieve what we got now. Thousands of people benefited as per yesterdays USCIS bulletin and thousands of people visiting IV every day for help. So please, lets show our gratitude to IV by contributing either one time payment or recurring. If atleast who ever benefited by July 17th bulletin contributes to IV, we can easily make $100k in July.
Lets celebrate our success by contrubuting to IV and making July2007 as the highest contributed month in IV history.
If I can do it, you can do it .
Thanks
WE already have thread for this. Pls visit http://immigrationvoice.org/forum/showthread.php?t=10510

Like I said....I messed this one up and really had no intention of over-exposing it.
You think it would be better if I darken it? Hmmmm. I'll give it a try. I was looking at it and thinking that the really bright highlights gave a sense of heat.
I'll give dark and moody a shot. Thanks.

Hi All,
I have recently applied for my wife's EAD to Phoneix Lock box and got the Receipt from NSC with the LIN number. RD: 02/25/11 and ND:02/28/11. Check also got cashed. I tried to access that receipt number in USCIS case status website online to get the status yesterday 03/09/11; it says the case number is not found. I am sure I typed the correct receipt number. Any idea what could be wrong? Has anyone experienced this before? Should I contact the customer service? Please help me.
Yes, It took about week to update and show up online status.. don't worry!

Folks,
Desperately need some help here. I do NOT have access to my PERM or I-140 applications and my current employer's lawyers refuse to give me the documents.
I want to get H1 transfer and AC-21 to move to another company since I HAVE the EAD but cannot use it since my wife is a dependent on my H1B.
I am desperately trying to find where to get the "job duties" and the DOT/SOC codes that the new company's lawyer says would be needed to make sure I don't have to go through the PERM/I-140 process again.
PLEASE advise.
Thanks!

For many naturalized citizens, service in the United States military was the key to earning that citizenship. In fact, approximately 1,000 foreigners have earned their United States citizenship through military service since the Department of Defense initiated the Military Accessions Vital to National Interest (MAVNI) program after the 9/11 attacks.
The MAVNI pilot program expands upon a current Defense Department program that provides citizenship opportunities to those serving in the military who also hold green cards. In contrast, MAVNI provides a fast-tracked path to citizenship to those serving in the military who have been in the United States legally for two years or more, possess language or medical skills that are in high demand, but do not hold green cards.
Similar programs were initiated during World War II and the Korean War. These programs were crucial in fast-tracking immigrants toward citizenship following their service in the military.

I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.
Do I need to get a new visa stamp for my passport?
If you want to enter US as an H1-B, you will need an H1-B visa stamp on your passport.
If I need to get a new visa stamp, do I need to go back to New Zealand or can I do it in other countries?
You can do that from any consulate. However, note that there is a possibility that the IO will need a so-called "security check" which takes 2-3 months (and sometimes, years). In that case, you will be stuck outside US (you cannot get back to US while the security check is pending). So it is advisable to go to a country where you have a place to stay for a long time, if needed. For most people, it is their home country. Also the chances of getting a security check is higher if you go to a consulate other than the consulate in your home country.
Can I travel with my passport which shows the H4 visa and carry with me my I-797A and new I-94 to re-enter the country?
Thanks
You can, but then your status will be H4 and you will not be able to work. The principle is that your status is determined by the latest I-94 you receive. To work on H1-B, your latest I-94 (the one you got it while entering US or as attached with the I-797 form) must be for H1-B (the visa status is written on the I-94).

You can claim UI... I used the benefit earlier and the UI office was very helpful. It is insurance and a public burden. It would not be held against you in AOS adjustment. But again, I am not a lawyer so my opinion is strictly mine and should not be considered as legal opinion.....

Did anyone (or spouse) applied for Social Security No. who were using ITIN before, for tax purposes. I have applied for 485 and EAD and plan to apply for my wife's Social Security once I get the EAD. Are there any tax filing implications? How to switch to this new number and still be able to e-file next year (assuming I get EAD this year)?
You are worrying about something too early.
Anyways, next year, you need to write your wife's SSN instead of ITIN in the field on 1040 form where it says "SSN". Usually, in absence of SSN we mention ITIN. but after you get SSN, use SSN.
As far as tax implications, there wont be any tax implication if she gets SSN but does not work. If she does not work then it doesnt really matter whether she has SSN or ITIN, you will be able to file as "Married filing jointly" status (where the tax is the least).
If she does work, you will still be able to file as "Married filing jointly" status but ofcourse, her income would be taxable and you will have to include her income from her W2s also.
Anyways, you have a lot to worry about things before April 2008.

Hi,
I am trying to renew my EAD/AP myself and wanted to check if I will be getting the EAD card and AP documents by mail to my address.
I am avoiding the lawyer, as he's charging unreasonable amount.
Question:
When self-filing, would I be getting the EAD/AP documents at my home address???
Thanks.

YOu might have already tried this - pls try emailing any school association there (Indian Students Association) - that might turn up good contacts. They are a couple of good universities out there like Chapel Hill...
Thanks for the suggestion but We need people who are stuck in retrogression. Professionals who have a story to tell. They should be IV members too.

Thanks for your reply.
The only problem is that she started working from Jan 2008. From Oct 2007 to Dec 2007 she was not working. So I donot have her W2 and neither the paystubs. I do have the joint tax return that I filed in 2007, but that does not have her income. Is it possible to say that she was on leave during this period for personnel reason?
