Does the bill have provisions to increase residency positions ? I heard few months back about hard lobbying to increase the match positions by 15000 to accomodate new patients because of the mandate. Any idea?

Thanks frostrated. When I said CPT I actually meant STEM Extension (17 month). Anyways, if I don't find employment before my OPT expires, can I go to back to school without an issue? I think I should be okay but I just wanted to make sure. I would appreciate it if I got any input on this matter. I need to double check myself to make sure I'm on a legal status
Yes, you can go back to school. But you also need to find out if you were in violation of your status. On OPT, you cannot stay without working for more than a set period of days.
Though that is rarely enforced, it is good to keep in mind.
You can get an OPT only once per degree level. So, if you got your OPT for a master's level program, you cannot get another OPT for a master's level degree. You can get one for the Phd though. So keep that in mind when you go back to school.

I would recomend you talk with Shela Murthy or Carl Shusterman, talk to the main lawyer directly, do not talk with the junior lawyer in the firm. Ask for urgent appointment, it would cost a bit more but it is worth it. I am sure Shela Murthy will find some way for you.

Hi All
My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
Can I travel on this document?
Please advise.

Dear Friends,
My PD (EB3)is Dec-02. I have gone for Finger Printing twice now.
I see lot of reference to '45 Day letter' in the forum . I have no recollection of receiving the '45 Day ' letter so far.
Am I missing something here?
Can any one of you please explain what this letter is about?

If you have done your FP twice.. you need to have fun, relax and forget about 45 day letter.. you passed that stage long time back.. this is basically for people who have labor certification pending with BEC.. just in case you don't know what BEC is.. its the Back Log Elimination Center set up to clear labor applications filled under the old system�.. and in case you don't know what the old system is ...........ok� its $5 for every further clarification..

Are people getting soft lud on 485 recently?.
The reason why i am asking this is my 485 did not have any LUD for past 1 year and i got one today for all my 485(mine,dependents). 140 did not have any LUD only 485s. No AP,EAD renewals..
I know from previous threads it means nothing. Just wanted to check. Was trying to not post about this but at last i posted.

I am on H-1 B , and planning to apply for Labor certification - working for an Automobile manufacturing Company in Engineering department,my qualifications are Bachelor in Mechanical Engineering-SOC CODE (17-2141), Masters in Industrial Engineering SOC CODE(17-2112).
Just want to ask can i use Commercial & Industrial designer SOC CODE(27-1021), as base cause for using this code is my current job responsibilities matches with it and also meeting Salary requirements, other two codes giving high salaries comparing this code - (flc data center),
By law do i have to use the same code in which my bachelor or master degree is OR it depends on my current job responsibility

As far as I understand, your degree is not the only criteria to decide the SOC code for labor certification. SOC code depends on the combination of your education qualification and your experience in the relevant field. Every job has a minimum qualification. But the minimum education qualification doesn't describe the SOC code. If you meet the minimum education qualification, you could apply for that job, but then one has to meet the required experience required for the job. I guess the combination of experience in the relevant field and the minimum education qualification together weigh in to decide the SOC code. If your employer and your lawyer feel comfortable with Commercial & Industrial designer SOC CODE(27-1021), then it is Commercial & Industrial designer SOC CODE(27-1021). ;)

You can reply to the RFE exactly as you stated. That your wife and child are abroad and will be applying for visas at the U.S. post to accompany you, therefore they do not have A numbers or receipt numbers.

USCIS will consider only your qualifications and experience only at the time of applying for labor against the jobs requirements. You dont have to update USCIS with your latest qualifications.

I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

It all depends on their background check and security requirements.
As a non-US citizen your EAD has the same worth as a H1B for these jobs. Same is the case for LPR's for US Federal jobs with various security clearance checks (where only US Citizens can apply).
I know contractors who work without citizenship, but for a employee it looks like US Citizenship is a basic necessity. Do you have any first hand knowledge? Thanks in advance.
