    I work in a private firm (<300 employees) and they have filed for PERM and is under audit. What would happen to my PERM if a bigger firm takes over my smaller company.

    My H1-B 6 yr limit will expire by January 2010. What are the risks to my immigration status if my company is acquired by a bigger firm?

    1. Will I have to re-file for PERM again with the new company?

    OR

    2. Can I continue under the already audited PERM in smaller company's name?

    As long as the successor company wants you to continue with them , you have no problem. You can ask your attorney to send details about acquisition if there is any RFE and you are safe.

    But you should really try to find out, if the future company would like to support your PERM, because that is more important - company support.

    Totally irrelevant to this forum. Administrator please review this thread.

    I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.

    I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

    This should be "Department of Homeland Security" per Attorney.

    for 482 the 2 checks of 325 and 70 and one check of 180$ for I765 should be payble to 'Department of Homeland Security', or 'United States Citizenship and Immigration Service'

    The form says it should be payble to 'Department of Homeland Security' and the immigration voice 485 help thread says it should be payble to 'United States Citizenship and Immigration Service' .

    Please suggest and sorry if this si a repost. I could not find a exact answer.

    Hi,

    My PERM got denied next day after filing 7th year H1B extension, Is my H1 will approve?
    extension filied on Premium processing. what are the chance me to continue on H1 and green card process.

    PERM filied: 12/10/2008
    Audit: 12/19/2009
    H1B ending: 02/19/2011
    H1B filied for 7th year extn: 01/18/2011
    PERM denied: 01/20/2011

    Please let me know if know such issues...

    Friends,
    Does anyone know if people who've filed for I-485 can claim unemployment insurance?......The client where I was working cancelled my project due to budget cuts :(....I was wondering if I can claim unemployment till I find a new job. Does any one know any non-desi companies hiring in the Michigan, Ohio, Illinois or Midwest in general?.....I am PMI certified Project Manager with J2EE background. Any prompt help would be highly appreciated.

    I just received an RFE for my I140 which says:

    The ETA Form 9089 you provided indicates a requirement for a Master's or Bachelor's degre in a certain field of study.

    Submit evidence that the alien obtained the required Masters or Bachelor's degree in Engineering or Computer Science, January 24, 2007. Evidence of education must be in the form of an official record showing the dates of attendance, area of concentration of study, and date of degree award, if any.

    The job offered is for a software enigineer.

    You have submitted a copy of a Masters Degree of Technology in Polymer Science and Technology and of the Bachelor's degree is in the discipline of Chemical Engineering with Speciality in Polymer Technology. If you have not been granted a Masters or Bachelors in the required field, provide proof that your degree(s) has the same elements as a Masters or Bachelors in the required field(s).

    How to proof that my degree(s) have same elements as a Masters or Bachelors in the required field(s) - the required fields being 'Engineering or Computer Science'? I think the confusion is because the title of my degree is 'Master of Technology' and not 'Master of Engineering'... same with Bachelors.. it is 'Bachelor of Technology' and not 'Bachelor of Engineering'. Anybody from India knows they are almost same. But how to prove it to INS?

    Please reply ASAP so that I have time to execute the suggested steps. Any help is greatly appreciated. Thanks in Advance...

    Gurus,

    My contract pre-maturly ended on Sep 27, 2008. I was on hourly rate on W2. So far I haven't find any assignment. I don't get paid.
    Am I eligible for unemployment benefits. Has anyone claimed this. Are there any future disadvantages if you show unemployment.

    In the interview letter I received they did ask for Medical but it also mentioned I could attend even if I do not have it. After attending the interview it did feel like that was the reason why they called us - they wanted my wife to go throught her medical again.

    Sorry I'm not sure of I684(Affidavit of Support). They did not ask me for it.

    Those of you planning to reach the 485/EAD "heaven". Please have a look at this
    link suggesting you apply for EAD 6 months in advance.

    Apply too early and you are screwed by an early approval that will render your EAD valid for just 6 months(my last 2 were approved within 2 weeks). Apply too late and risk unauthorised work and or having to get fired/stay off the job.
    All this just weeks after they removed the ability to get an emergency 90 day EAD at the local field offices if they delayed more than 90 days.
    The USCIS is getting very mean with those of us waiting in the legal queue in my view. A lot is going on behind the scenes, I hope we are not all made scapegoats of dumb policy in the end.

    This is an option given to me by my lawyer - I can change job within my company to a differenct category, even though Green Card Process has to be restarted, we can port the priority date. So it is an option....



    All,

    My friend works as an internal auditor within a big 4 acccounting firm. His practice is doing quite badly. As there are tons of different practices within this firm, he is thinking about transferring. But his PERM was filed for the internal audit manager position and his I-140 has alreday been approved. If he transfers to a function unrelated to internal audit within his firm (e.g. external audit, tax, fraud, etc.), would there be a problem?

    Can anyone here provide some guidance or point him to the right discussion thread?

    Hello,

    I read this on Oh-law website. I am a bit confused. Isnt it true that H1 is dual intent, why would they consider this as abandonment of 485 when one uses the automatic re-validation rule (no valid H1 stamp but valid I-94 stub on the 797 H1 approval)?

    From the Oh-law website:

    Those in pending I-485 green card proceedings should understand that travel over the contiguous countries without a valid H or L visa status or without an approved advance parole will result in a deadly consequence of abandonment of pending I-485 applications even if they are readmitted into the U.S. after a short trip to Canada and Mexico with an expired visa in the passport under the foregoing visa revalidation rule. Rule of readmissibility from such trip is one thing and abandonment of pending I-485 is the other. They should never depart from the U.S. without a valid H or L approved status or a valid Advance Parole.

    I had my parents and my grandmom visit me last year. All three of them went together for the visa interview at Delhi. The only question the officer asked my father was - Why do you want to take your Mom to visit the US 'now'? and my dad replied, 'If I do not take her now, when will I take her?'. They all got a 10 year visa.

    I got my receipts last weekend

    It was some what similar story for me.
    I my case my wife's app and mine got separated-
    Mine got rejected on grounds of incorrect fees (there was a single check)
    my wifes app turned up after a month or so
    we refiled and got the receipts

    I am now trying to find out what to expect for EAD and AP
    I wonder if special handling cases get a better turnaround

    Keep me posted with what happens with you- and maybe we can start to geta n ide as to what to expect next

    As per my knowledge as long as H1B extension is applied and is in pending status you can stay/work. Is it a perm or regular case? I had my perm approved in 2 weeks. Last time my employers did a regular and it took approx 3 months.
    If it gets rejected then you can use EAD, if you have one. Otherwise i think you have to leave the country in 30 days (or 15 days, i am not sure abt this).

    Thank you pal. Is it safe for her to apply for H4 while in India? or is better she apply after coming here? She wants to apply for H4 after coming to usa.

    Applying for H4 while being in India might be the easiest. She can still continue her studies on H4, if she wants.

    I am planning to work on EAD soon and switch my employer using AC21. How would USCIS know that I have switched from H1b to EAD. I might change my mind after 1 months and get back to H1 transfer and work on H1 instead on EAD.

    This depends on if the future project is long term and I switch to H1B just to be safe.

    Any ideas would be appreciated...

    so many complications, so many rules to know - we might as well be immigration attorneys!! we (or at least some of us) pretty much know more about the INS and immigration laws than the average immigration attorney :D
